1. Agreement and who may use the Service#
The Service is for businesses and the people who work for them. You must be at least 18 years old and be using the Service for business purposes. We do not knowingly collect personal information from anyone under 18; if we learn we have, we will delete it. If you sign up for a company, you represent that you are authorized to bind that company to these Terms, and “you” means both you and the company.
These Terms and our Privacy Policy together make up the whole agreement. If you do not agree, do not use the Service.
2. Accounts, owners and seats#
Each account belongs to a company. The person who creates it is the account owner. The owner can invite teammates where the plan allows and can remove them. Give us accurate information, including your company name and CAGE code, and keep it current, including your account email address, because we may send notices there. Do not enter a CAGE code that is not yours or that you are not authorized to use. We do not verify email addresses or CAGE codes.
If you believe someone has used your company name or CAGE code without authorization, email support@nsnrecon.com. We may suspend the account or remove listings while we look into it, and may ask for proof of your authority (for example, confirmation from the contact on your SAM.gov registration) before restoring them.
Your plan sets how many people may be signed in at the same time (your “seats”). If all seats are in use, a further person may be unable to sign in until someone signs out or the session goes idle. Do not share one login among several people, and do not use the Service beyond the seats you are licensed for.
You are responsible for keeping your password and login details secure and for everything done under your account, including by teammates. Anyone signed in to your account can see and change that account’s data, including its watch list, notes, decisions, inventory listings and settings, and can cancel or reactivate the account. Tell us promptly at support@nsnrecon.com if you think your account has been used without permission.
3. The Service, plans, trials and fees#
NSN-Recon lets you search National Stock Numbers, CAGE codes, part numbers, awards and solicitations, keep a watch list and bid notes, look up items in batches and view surplus lots. Posting inventory listings is available on Pro and Enterprise plans, and the AI assistant on Enterprise plans. Which features, seats and usage limits you get depend on your plan, as shown in your account or agreed with us in writing. We may change features and limits over time, and we will give notice under section 15 when a change is material.
New accounts start as a free trial account. It has no fixed end date, and we may change, limit or end it, or the Service, at any time. Where we reasonably can, we will give at least 14 days’ notice and a chance to export your data. We do not currently charge for the Service. If and when we start charging, fees will be those agreed with you in writing or shown in the plan at signup or upgrade, and we will tell you before we charge you anything. Nothing on your account will convert into a paid plan without your agreement, and any paid plan will be governed by additional terms you accept at that time.
Programmatic API access is not offered as a self-serve feature. Signed-in browser sessions can reach JSON endpoints used by the site, and any other API or MCP access is only by arrangement with us and subject to these Terms and the limits we set.
4. Acceptable use#
You will use the Service only for lawful business purposes. You will not:
- scrape, crawl or use automated means to extract data in bulk from the Service, other than the exports and any API or MCP access we expressly give you;
- resell, republish or redistribute our compiled data, or use it to build or feed a product that competes with the Service;
- get around usage limits, seat limits, plan restrictions or security controls, or share credentials beyond your licensed seats;
- probe, scan or test the Service for weaknesses, or interfere with it or other customers’ use of it;
- upload, attach, paste or enter classified information, controlled unclassified information (CUI), export-controlled technical data or drawings, or any material you are not allowed to share, into the Service, including into notes, inventory listings and the AI assistant (as pasted text or as an attached file);
- use the AI assistant to generate unlawful, deceptive or harmful content, or to attack or overload it; or
- post inventory listings that you do not have the right to sell or that you know to be false or misleading.
The Service is not designed, certified or authorized to handle classified, CUI, ITAR or EAR-controlled information, and it has not been assessed under FedRAMP, CMMC or NIST SP 800-171. If you upload such information, you do so in breach of these Terms and you are solely responsible for any resulting violation. We may delete it without notice and may report it where the law requires.
You represent that you are not a debarred, suspended or sanctioned party or otherwise barred from receiving U.S.-origin items or services, and you will not use the Service in violation of U.S. export-control or sanctions laws.
We may limit, block or remove content or access that we reasonably believe breaks this section.
5. Government data: verify before you rely#
We compile data that governments publish. We do not create it, and we do not guarantee it. The Service draws on public sources including the DLA FLIS and PUB LOG reading room, DLA FOIA procurement history, SAM.gov opportunities, DIBBS, NECO (Navy), USAspending and FPDS, GSA Auctions, and procurement records released by the Air Force under FOIA. Our Data page lists the sources and their publication dates.
The data is provided as is. It may be incomplete, out of date, mis-matched or wrong. Records may be missing or changed after we collect them. Some records are read from scanned documents and may contain errors. Matching a notice or surplus lot to an NSN is done by pattern and may be missed or mistaken. Prices, quantities, forecasts, lead times, the competitor score and any bid, watch or no-bid indicator are aids to your own judgment. They are not quotes, offers, advice or recommendations. Nothing in the Service is legal, contracting, accounting, compliance or business advice.
You must check the official source (for example DIBBS and SAM.gov) before you bid, quote, buy or sell, or rely on any price, forecast, competitor score, match or bid/no-bid indicator. Decisions you make are yours.
Scores and indicators are opinions computed from public records using automated rules. If you believe a record about your company is wrong, email support@nsnrecon.com and we will review it and correct errors as soon as reasonably practicable. Some sources have their own terms of use, and government records may contain errors or markings we did not catch. If we display information that a government agency asks us to remove, we may remove it without notice.
NSN-Recon is not affiliated with, endorsed by, sponsored by or approved by the DLA, the Department of Defense, the Air Force, GSA, SAM.gov or any other government agency. Names of agencies and systems are used only to say where data comes from, and we do not use government seals or logos.
6. Your content and inventory listings#
Your Targets (watch list), notes, bid decisions, inventory listings and other things you put into the Service (“your content”) remain yours. You give NSN Recon a non-exclusive licence to store, process, display, back up, review, correct, export, and use your content, your usage of the Service, and any other data you put into the Service, for support, operations, product improvement, and NSN Recon's own business, as described in the Privacy Policy, and to comply with law. That licence is not limited to helping you when you ask.
Your watch list, notes and bid decisions are not shown to other customers. They are not private from NSN Recon. NSN Recon may view and use any of that data as the Privacy Policy describes.
Inventory listings are different: they are shared. When you post an inventory listing, you give us permission to show it to every other signed-in customer who views that item. They will see your company name, your CAGE code, and the quantity, price, condition and note you entered. Listings appear as soon as you post them and stay visible until you remove them or we remove them. You can remove your own listings at any time from the Inventory page. Other customers may have already viewed or copied a listing before it is removed, and we cannot retract that. Do not put anything in a listing, including the note, that you do not want other customers to see.
By posting a listing you represent that you own the item or are authorized to sell it; that it is genuine and not counterfeit or suspect; that it is not subject to any restriction on sale or export and is not government property or surplus that must be demilitarized; that your description, price and condition are accurate; and that you will comply with all laws, including export-control and counterfeit-parts rules. Users are solely responsible for their own compliance with antitrust and competition laws in their pricing.
We are not a seller, broker or dealer and are not a party to any transaction. We do not process sales, hold money, verify listings or users, check condition or authenticity, or resolve disputes between customers, and we are not responsible for any transaction. Any deal is between you and the other party. We may remove any listing at any time, and we will review reports of infringing, false or unlawful listings sent to support@nsnrecon.com.
7. AI features#
Some plans include an AI assistant that reads text you paste or files you attach (PDF, Excel, CSV or text), such as an RFQ or parts list, and pulls out line items. AI output is generated by a third-party model, can be wrong or incomplete, and is not reviewed by us. Treat it as a starting point. You are responsible for verifying it and for how you use it. Matching of items to NSNs is then done by our own code and is also subject to section 5.
Text you paste and files you attach, including their file names, are sent to Google (the Gemini API), up to 20,000 characters of pasted text and up to five files (8 MB each, 14 MB in all), as described in our Privacy Policy. Google’s terms for the access we use may allow Google to retain it, use it to improve its products, and have people review it. Do not paste or attach anything that is confidential, personal, classified, CUI or export-controlled, or that you are not allowed to share with a third-party service. You are responsible for having the right to send a customer’s RFQ, and any documents attached to it, to a third-party service: check its own terms and markings first. We are not responsible for Google’s handling of what you submit. AI features have usage limits that depend on your plan; one extraction counts as one use, however many files it includes.
8. Our intellectual property and your feedback#
We own the Service, including its software, design, scoring methods, and our selection and arrangement of compiled data. We do not claim ownership of the underlying government records. We give you a limited, non-exclusive, non-transferable right to use the Service for your own internal business purposes while these Terms are in effect. All other rights are reserved.
If you send us ideas, suggestions or other feedback, we may use them without restriction or payment. You keep ownership of your content.
9. Third-party sites and links#
The Service links to sites we do not run, such as DIBBS, SAM.gov, GSA Auctions and GovPlanet. We have no relationship with them beyond linking. We do not control them and are not responsible for their content, availability or terms. Some require their own registration or credentials. Your use of them is at your own risk and under their terms.
10. Suspension, cancellation and what happens to data#
You may cancel at any time from your account settings page or by emailing support@nsnrecon.com. Cancelling ends your access to the product pages. You can still sign in to manage account settings and can reactivate. Cancelling does not by itself delete your data, and it does not remove your inventory listings. If you want your listings gone, remove them before you cancel, or ask us to.
We reserve the right to suspend or end your access if you break these Terms or put the Service or other customers at risk, or if we stop offering the Service. Where we reasonably can, we will give notice as described in section 3.
After cancellation or termination, you can ask us at support@nsnrecon.com to delete your account and its data, and to remove your inventory listings. We handle these requests by hand, once we have verified the request. We aim to finish deleting an account within 30 days, and to remove listings within 10 business days. Copies may remain in server logs and hosting-level copies until they are overwritten, and we may keep what the law requires or what we need to enforce these Terms or resolve a dispute. We make no promise to keep backups of your content, so keep your own copies. Details are in the Privacy Policy. Sections that by their nature should survive (including sections 4, 5, 6, 8, 11 to 14 and 17) survive termination.
11. Disclaimer of warranties#
The Service and all data, scores, forecasts, matches, indicators and AI output are provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, timeliness, title and non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free, that any data is correct or current, or that any result will meet your needs. We use reasonable safeguards described in the Privacy Policy, but no system is completely secure. We do not promise any particular business result, including winning any bid or contract.
12. Limitation of liability#
To the fullest extent the law allows, we will not be liable for any lost profits, lost bids, lost contracts, lost business or opportunities, lost data, or any indirect, incidental, special, consequential, exemplary or punitive damages, however caused and on any theory, even if we were told they were possible. Our total liability for all claims relating to the Service or these Terms will not exceed the greater of (a) the fees you paid us for the Service in the twelve months before the event giving rise to the claim and (b) one hundred U.S. dollars (US$100).
These limits apply to us and to our officers, employees, contractors, suppliers and data sources. They are an essential part of the basis of the bargain, because the Service is currently provided without charge, and they apply even if a remedy fails of its essential purpose. Nothing in these Terms limits liability for fraud, willful misconduct or gross negligence, or any liability that cannot be limited by law. Some jurisdictions do not allow certain limits or exclusions, so some of the above may not apply to you. In that case our liability is limited to the smallest extent the law allows.
13. Indemnification#
You will indemnify us and our officers, employees and contractors against third-party claims, and resulting losses and reasonable costs (including reasonable attorneys’ fees), to the extent caused by (a) content you post, including inventory listings, that you had no right to post or that infringes or is unlawful, (b) your breach of section 4, or (c) your violation of law. We will give you prompt notice of the claim and let you control the defense with counsel reasonably acceptable to us. You may not settle a claim in a way that admits fault by us or imposes obligations on us without our written consent. We may join the defense with our own counsel at our own cost.
14. Governing law and disputes#
These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods does not apply. Before either of us starts a formal proceeding, we will each try in good faith to settle the dispute informally: send a written description to the other (to us at support@nsnrecon.com) and allow 30 days to work it out. Either of us may seek an injunction or other equitable relief in court at any time, without following that process, to protect intellectual property or confidential information.
Otherwise, any claim must be brought in the state or federal courts located in Alabama, and you and we consent to their jurisdiction and venue. Any claim must be brought within one year after it arises. Each of us waives trial by jury and the right to bring or take part in a class action.
15. Changes to these Terms#
We may update these Terms. For a material change we will give at least 30 days’ notice by an in-app notice or by email where email delivery is enabled, and we will update the effective date at the top of this page. Changes apply going forward and do not affect a dispute already begun. We may make a change effective immediately where needed for legal compliance or security, and we will post notice of it. If you keep using the Service after a change takes effect, you accept the updated Terms. If you do not accept them, cancel before the change takes effect.
16. Electronic communications and the daily digest#
You agree that we may give you notices and other communications electronically, by email or in the app, and that these meet any legal requirement that they be in writing. Where email delivery is enabled we may send service emails such as password resets and teammate invitations; otherwise we may give you a one-time link directly.
The daily digest is optional. If you enter a digest email address on your account page, we may email you a daily digest of new solicitations that match your watch list once our email service is enabled. Only enter an address you are authorized to use, because the digest goes to whatever mailbox you enter, even if it belongs to someone else. To opt out, clear that address on your account page or email support@nsnrecon.com, and we will honor the opt-out within 10 business days.
17. General terms#
- Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the Service and replace earlier understandings. A written agreement signed by both of us may add to or override these Terms for you, and if it conflicts with these Terms, it controls for its subject matter.
- Severability. If a part of these Terms is held unenforceable, the rest stays in effect and the part will be enforced as far as the law allows.
- No waiver. If we do not enforce a right, we have not given it up.
- Assignment. You may not assign these Terms without our written consent. We may assign them to an affiliate or to a successor to the business.
- Force majeure. Neither of us is liable for a failure or delay caused by events beyond reasonable control, such as natural disaster, war, government action, internet or power failures, or the unavailability of a data source. This does not excuse a payment obligation.
- Independent parties. We and you are independent parties. These Terms create no third-party beneficiaries.
- Publicity. We may identify you as a customer only with your consent.
- Government end users. The Service is commercial computer software and data, provided to government users with only the rights granted to commercial customers.
- Notices. We may give notice to the email address on your account or in the app, and notices we send are effective when sent. You may give notice to us at support@nsnrecon.com or by mail to the address below.
